These Terms & Conditions (“Terms”) govern reservations made directly through thehogmountainchalet.com for The Hog Mountain Chalet, located in Fleischmanns, New York (the “Property”). “We,” “us,” and “our” refer to the owner of the Property. “You” and “Guest” refer to the person making the reservation and everyone staying at or visiting the Property during the reservation. By completing a booking, you confirm that you have read and agree to these Terms on behalf of yourself and your entire party.

Reservations made through third-party platforms such as Airbnb or VRBO are governed by that platform’s terms and the house rules and cancellation policy shown on that listing.

1. Reservations and Eligibility

• The person making the reservation must be at least 25 years old, must stay at the Property for the entire reservation, and is responsible for the conduct of every member of the party and every visitor.
• A reservation is confirmed only after full payment is received and you receive a written confirmation from us.
• You agree to provide accurate and complete information when booking, including the number of guests and any pets.

2. Rates, Payment, and Fees

• Payment in full is due at the time of booking. Payments are processed securely by our third-party payment processor (such as Stripe or PayPal).
• Rates are quoted in U.S. dollars and include any applicable taxes and fees shown at checkout.
• A pet fee of $50 per stay applies to each reservation that includes a dog (see Section 7).
• Firewood and fire starters are available for a fee of $25.
• Rates may change at any time, but the rate confirmed at the time of booking will be honored.

3. Cancellations and Changes

• Cancellations made 30 or more days before check-in: full refund.
• Cancellations made fewer than 30 days before check-in, no-shows, and early departures: no refund.
• Date changes are subject to availability and must be approved by us in writing. Any difference in rate will be charged or refunded.
• Refunds are issued to the original payment method.
• We strongly recommend purchasing travel insurance to protect your trip against illness, weather, travel disruptions, and other unexpected events.

4. Weather, Road Conditions, and Events Beyond Our Control

• The Property is in the Catskill Mountains, where snow, ice, and storms are common, especially from November through April. Winter travel may require all-wheel or four-wheel drive and snow tires. Weather, road conditions, ski conditions, or closures of local businesses or attractions are not grounds for a refund.
• If the Property becomes unavailable or unsafe for reasons beyond our control (for example, fire, flood, storm damage, extended utility outage, or a government order), we will make reasonable efforts to notify you and will refund amounts paid for the nights that cannot be provided. This is our only obligation in that situation.
• Temporary interruptions to utilities, Wi-Fi, television, the hot tub, or appliances may happen in a rural mountain setting. We will make reasonable efforts to fix them promptly, but they do not entitle you to a refund.

5. Check-In and Check-Out

• Check-in is after 4:00 PM. Check-out is before 11:00 AM. Early check-in or late check-out may be available on request and must be approved in advance.
• Check-in is self check-in by keypad. Your entry code will be sent before arrival and must not be shared outside your party.
• Unapproved late check-outs may result in an additional charge.

6. Occupancy, Visitors, and Events

• Maximum occupancy is 8 guests. Only guests listed on the reservation may stay overnight.
• Daytime visitors are allowed only with our prior approval, and total persons on the Property may not exceed 8 at any time.
• Parties, events, and gatherings beyond the registered guests are not permitted without our prior written approval. Guests attending nearby weddings are welcome, but the Property may not be used as a wedding or event venue.
• Violating the occupancy or event rules may result in immediate termination of the stay without a refund.

7. Pets

• Well-behaved dogs are welcome with advance notice and payment of the $50 pet fee. Limit: 2 dogs. Other animals are not permitted without prior approval.
• Dogs may not be left unattended at the Property, must be kept off beds and furniture unless covered, and must be cleaned up after on the grounds.
• Guests are responsible for any damage, extra cleaning, or complaints caused by their pets.

8. House Rules

• No smoking or vaping of any kind inside the chalet. Smoking is permitted outdoors only in designated areas, and all butts must be fully extinguished and disposed of. Violations may result in a cleaning fee of $250.
• Please treat the home as your own: turn off lights, electric fireplaces, and appliances when not in use, and lock doors and close windows when leaving.
• Please place all trash in the provided containers and keep them closed. Black bears and other wildlife are active in the Catskills. Do not leave food or garbage outside.
• Fireworks, firearms, and illegal substances are prohibited on the Property.
• Commercial photography is permitted. Commercial filming, events, or productions require our prior written approval.

9. Hot Tub, Fire Pit, Fireplaces, Pond, and Outdoor Areas

The Property includes features that carry inherent risks, including a hot tub, an outdoor fire pit, a wood-burning fireplace, electric fireplaces, a pond, a deck, and wooded, uneven, and seasonally icy terrain. By using the Property, you accept these risks for yourself and your party and agree to use these features responsibly:

• Hot tub: Use is at your own risk. Children must be supervised by an adult at all times. Do not use it while under the influence of alcohol or drugs, and use caution if pregnant or if you have a medical condition. No glass in or around the hot tub. Keep the cover closed and secured when not in use. Do not adjust the chemicals or equipment.
• Fire pit and fireplaces: Fires must be attended by an adult at all times and fully put out before you leave them or go to bed. Use only the firewood provided. Never use accelerants such as gasoline or lighter fluid. Do not have outdoor fires during burn bans or high winds. Fires may be used only in the designated fire pit and the indoor wood-burning fireplace.
• Pond and grounds: The pond is not supervised and is not intended for swimming. Children must be supervised by an adult near the pond and on the grounds at all times. Walkways, steps, driveways, and the deck may be slippery in wet, icy, or snowy conditions. Please use caution.

10. Damage and Guest Responsibility

• You are responsible for any loss of or damage to the Property, its contents, or its grounds caused by you, your party, your visitors, or your pets, beyond normal wear and tear. Please report any damage or problems to us promptly.
• You agree to reimburse us for the cost of any such damage, missing items, excessive cleaning, or violations of these Terms. We will provide an itemized explanation of any charges.
• Excessive cleaning required beyond normal use (for example, from smoking, pets, or parties) may result in an additional cleaning fee.

11. Access and Right to Terminate a Stay

• We or our representatives may enter the Property with reasonable notice to make repairs or inspect it, or without notice in an emergency.
• We may end a stay without a refund if a guest breaks these Terms in a serious way, including violating the occupancy or event limits, creating a safety hazard, damaging the Property, engaging in illegal activity, or disturbing neighbors after being asked to stop.

12. Assumption of Risk and Limitation of Liability

To the fullest extent permitted by law, you and your party use the Property, its amenities, and the surrounding grounds at your own risk. We are not responsible for loss, theft, or damage to your personal property or vehicles, or for injury, illness, or loss arising from your use of the Property, except to the extent caused by our gross negligence or willful misconduct. Our total liability arising from any reservation will not exceed the amount you paid for that reservation. You agree to indemnify and hold us harmless from claims, damages, and expenses, including reasonable attorneys’ fees, arising from the acts or omissions of you, your party, your visitors, or your pets.

13. Privacy

Our collection and use of your personal information is described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or a reservation shall be brought exclusively in the state or federal courts located in Delaware County, New York.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with your booking confirmation and any written house rules provided at the Property, are the entire agreement between you and us about your reservation. We may update these Terms from time to time; the version in effect when you book applies to your reservation.
